Youth serving their sentences in open custody settings also experience greater freedom of movement within the institution and are afforded a greater number of privileges, such as increased visitation rights and the ability to retain a wider variety of personal belongings in the institution. Typically, younger, less serious and/or first time offenders are sentenced to open custody, while the chronic, serious and violent offenders are more likely to be sentenced to a secure custody facility. As a result, the ability to sample from both secure custody and open custody institutions provides a diverse sample of youth and offending patterns, ranging from relatively minor offenders to the most serious and violent incarcerated youth.

Once again, regardless of the specific form that the intervention takes, all restorative justice initiatives stress the participation of the offender, the victim and the community (Simms 1997). All decisions must be based on the principles of fairness and reconciliation. Moreover, the needs of the offender and the victim, and the safety of the community, must be paramount. All interventions must ensure that the offender accepts responsibility, and is accountable to themselves, their victims and the community.
